Sioux Falls, South Dakota – Judge Karen Schreier, a federal judge in Sioux Falls, South Dakota, allowed a lawsuit against the Yankton Medical Clinic to proceed when Cutler Law Firm, LLP attorneys Mike Bornitz and Bob Trzynka argued that the Yankton Medical Clinic committed an anti-trust violation when it refused to provide medical services to Plaintiff, Connie Howes.
Thomas Horton, a law professor at the University of South Dakota said that the ruling was significant. Nationally, courts are making it increasingly difficult for antitrust cases to proceed. He called Judge Schreier’s opinion “reasoned and thought out.”
